1GOVERNMENT OF PAKISTANNATIONAL COUNCIL FOR HOMOEOPATHYUNANI, AYURVEDIC AND HOMOEOPATHICSYSTEM OF MEDICINE,RULES -1980(Amended upto 19th October 2018 – vide Notification No. F. (1)/2018Dated 19th October 2018FRAMED UNDER SECTION 46 OF THE UNANI, AYURVEDIC ANDHOMOEOPATHIC PRACTITIONERS ACT, 1965 (II OF 1965).2S.R.O. 412 (I)/80.- In exercise of the powers conferred by section 46 of the Unani, Ayurvedic and Homoeopathic Practitioners Act, 196 (II of 1965), the Federal Government, after consulting the National Council for Tib and National Council for Homoeopathy, pleased to make the following rules, namely:-1. Short title and commencement.- (1) These rules may be called the Unani, Ayurvedic and of Homoeopathic System of Medicine Rules, 1980.(2) They shall come into force once.2. Definitions.- In these rules, unless there is anything repugnant in the subject or context.-(a) “Act” means the Unani, Ayurvedic and Homoeopathic Practitioners Act, 1965 (II of 1965);(b) Omitted.(c) “candidate” means a registered or listed practitioner or, as the case may be, a registered teacher of an approved or recognized institution, in respect of whom nomination has been submitted under sub rue (1) of rule 21;(d) Omitted.(e) “election” means election of the Council, and includes election to fill a casual vacancy in the membership of the Council;(f) “form” means a form appended to these rules;(g) “Ordinance” means the Unani, Ayurvedic and Homoeopathic Practitioners (Amendment) Ordinance, 1978 (XXXII of 1978);(h) “Polling Officer” means an Officer of the Government appointed as such by the Returning Office;(i) “register” means a register of practitioners of the Unani, or Ayurvedic or Homoeopathic system of medicine, or, the case may be, the register of teachers of the approved or recognized institutions;(j) “Registrar” means the Registrar of the Council;(k) “Returning Officer” means a person appointed by the Federal Government who shall conduct the elections of the Council;(l) “section” means a section of the Act; and(m) “voter” means a person whose name appears on the list of voters published under sub-rule (5) of rule 20.33. Forms of registers and list of practitioners.- The registers and the list of practitioners required to be kept and maintained by the Registrars of the Council shall be in the following forms, namely:-(a) Register of qualified practitioners of the Unani system of medicine, register of qualified practitioners of the Ayurvedic system of medicine and register of the qualified practitioners of the Homoeopathic system of medicine, in form I.(aa) Similarly a separate register for qualified practitioners having degree from any recognized university and recognized by the Council, and for those registered under sub-section (2) of section 24 of the Act;(b) Register of the practitioners of the Unani system of medicine, other than qualified practitioners of that system, registered as Tabibs in category B under section 25, register of practitioners of the Ayurvedic system of medicine, other than qualified practitioners, of the that system, registered as Vaids in category B of that section, and the list of Homeopaths, other than qualified practitioners of the Homoeopathic system of medicine, prepared by the Registrar of the National Council for Homoeopathy under section 27, as those sections were in force immediately before the commencement of the Ordinance XXII of 1978 in form II.4. Application for registration of practitioners.- (1) An application for registration of practitioners under section 24 shall be made:-(a) in the case of the Unani and Ayurvedic systems of medicine, to the Registrar of the National Council for Tib, in form III; and(b) in the case of the Homoeopathic System of medicine, to the Registrar of the National Council for Homoeopathy, in form IV.(1-A) Persons who obtain degree or diploms in the Unani, Ayurvedic or Homoeopathic System of medicines as a regular students from a recognized institution in the country or from abroad, duly verified by the Embassy of Pakistan in that country may apply for registration to the Registrar of the respective Council on prescribed form.(2) Each applicant duly qualified shall submit an application accompanied by a bank draft or online payment of one thousand rupees drawn in favour of the Council as registration fee.(a) applicant duly qualified bachelor of eastern medicine system or bachelor of homoeopathic medicine system from any university recognized by the Council shall submit an application accompanied by a bank draft or online4payment of two thousand rupees drawn in favour of the Council as registration fee; and(b) applicant duly registered with Pakistan Medical and Dental Council shall submit an application accompanied by a Bank draft or online payment of ten thousand rupees in favour of the Council as examination fee.(3) The form of application shall be obtained from the office of the Council or, downloaded from the website of the Council;(4) Subject to the provision of the Act, the registration of a practitioner under these rules shall be valid for a period of four years from the date of issuance of registration and shall thereafter be renewable for every period of four years on application of the practitioner accompanied by a bank draft or online payment drawn in favour of the Council or as may be notified by the Ministry concerned as renewal of registration fee in Form IV-A or Form IV-B as under:-(a) for Fazil-Tibb-wal-Jarhat (FTJ) / Diploma in Homoeopathic System of Medicine (DHMS) one thousand rupees;(b) for Bachelor of Eastern Medicines System (BEMS) and Bachelor of Homoeopathic System of Medicine (BHMS) two thousand rupees;(c) for registration card ordinary two hundred rupees, card Poly Vinyl Chloride (PVC) five hundred rupees; and(d) those practitioners who have attained the age of sixty years and having ten years practicing experience shall be eligible to renew their registration for life time at following rates, namely:-(i) for Fazil-Tibb-wal-Jarhat (FTJ) / Diploma in Homoeopathic System of Medicine (DHMS) five thousand rupees; and(ii) for bachelor of eastern medicine system or bachelor of homoeopathic medicine system ten thousand rupees; andProvided that the registration of practitioner made at any time before the 31st day of December 2002, shall continue to be valid until the 31st day of December 2003.(5) In case of non-renewal of registration within ninety days after expiry date of registration, the original registration shall be deemed to have been suspended and the practitioner shall be liable to fine of two hundred rupees per year. The Registrar shall upload and keep updated district wise list of the practitioners on website of the Council.55. Forms of registers of teachers.- For the purposes of clause (c) of section 4 and clause (c) of section 5, the Registrar concerned shall keep and maintain the following registers in form V, namely:-(i) register in respect of the teachers of all the recognized institutions of the Unani system of medicines;(ii) register in respect of the teachers of all the recognized institutions ofAyurvedic system of medicine; and(iii) register in respect of the teachers of all the recognized institutions of the Homoeopathic system of medicines.6. Registers to be signed by Registrar.- The names of all practitioners and teachers in a register or list shall be in serial order, and each page of the register or list shall be signed, and each addition to, or alteration or correction in, an entry therein shall be initiated by the Registrar.7. Fee for change of entries in a register of list.- Any registered or listed practitioners who desires to have an addition made to an entry relating to him in a register or list of practitioners, or to have any change or correction made in such entry, shall pay a fee of hundred rupees;Provided that no fee shall be charged for correcting a typographical error or for noting a change in address.8. Certificate of registration.- (1) Every practitioner whose name is entered in a register of list shall be entitled to receive a certificate of registration from the Registrar, and such certificate of registration shall set forth the name, qualification, of the registered practitioner in full, his father’s name, number of the registration, address, date of registration, Computerized National Identity Card (CNIC) number, qualification and the provision of the Act under which he is registered.(2) Where a registered practitioner has lost the original certificate of registration he may obtain a duplicate certificate of registration by submitting an affidavit on a stamp paper on payment of five hundred rupees to the Registrar.(3) The Registrar shall issue the registration, renewal or duplicate of registration to the applicant within 30 days of receipt of application through registered post.69. Fee for recognition of teaching institutions.- (1) An application for the recognition of an institution imparting or desiring to impart instructions in the Unani, Ayurvedic or Homoeopathic system of medicine shall be accompanied by a non-refundable initial fee of fifty thousand rupees.(2) On receipt of an application under sub-rule (1) the Council, shall, within three months, inspect or cause to be inspected the building of the institution to verify that it meets the laid down requirements and submit a report with its recommendations to the Federal Government for further action.(3) If the Federal Government deems it fit to grant recognition to an institution under section 17 of the Act or this rule, it shall direct the applicant to further deposit a fee of rupees two lac within such period as may be prescribed.(4) No institution shall be established in rented building. The institution presently working in rented building shall have to arrange for its own building within a period of five years after notification of these rules.(5) Inspection fee of five thousand rupees shall be paid, after every year, by the institution recognized.(6) No recognized institution shall change its building, where recognized, without prior approval of the Council and shall deposit fifty thousand rupees in favour of the Council as building change fee.9-A Registration of teaching institutions for Bachelor of Eastern Medicines and Bachelor of Homoeopathic System. (1) An application for registration of teaching institution for Bachelor of Eastern Medicines and Bachelor of Homoeopathic System of Medicines shall be accompanied by a non-refundable initial fee of one hundred thousand rupees. (2) On receipt of an application under sub-rule (1) the Council, shall, within three months, inspect or cause to be inspected the building of the institution to verify that it meets the laid down requirements and submit a report with its recommendations to the Federal Government.(3) If the Federal Government deems it fit to grant recognition to an institution, it shall direct the applicant to further deposit a fee of three hundred thousand rupees within such period as maybe prescribed.10. Students to be enrolled with the Council.- (1) The Principal of every recognized institution shall send to the Council, only verified from concerned board or university education certificates of students, within a period of ninety days from the date of the beginning of the academic session starting from 1st July to 30th September year, along with a fee of five7hundred rupees in form online or bank draft payable to Registrar of the respective council for each student for enrolment with that council, and where the name of a student is sent within thirty days after the expiry of that period along with additional fee of one thousand rupees as late fee charges:Provided that maximum age limit for student seeking admission in the first year of Fazil-Tibb-o-Jarahat and diploma in homoeopathic system of medicine shall be not more than forty five years, however life sciences graduate shall get the admission up to fifty years for receiving second degree or diploma. College wise enrolment list shall be notified and uploaded on website of the Council within one month after the closure of session.(2) The dean of every recognized faculty of bachelor of eastern medicine system or bachelor of homoeopathic medicine system shall send to the Council, list of students with in period of ninety days from the date of beginning of academic session, alongwith fee of one thousand rupees in form of online or bank daft payable to registrar of respective Council for each student’s enrolment in that Council, and where the name of the student is send within thirty days after expiry of that period with additional fee of two thousand rupees as late fee. 11. Term of office of member of Examining Body.- A member appointed to an examining body under sub-section (3) of section 22 shall hold office for a period of five yearsor till such time a fresh member is appointed unless earlier removed by the Federal Government on the recommendations of the Council.12. Examination fees, etc.- The fees for Annual / Supplementary examinations to be held under the supervisions of the Act, and other charges relating thereto, shall be as follow, namely.-(i) fee for first and second year’s examination : Rs. 600/-(ii) fee for third and fourth year’s examination : Rs. 800/-(iii) fee for practical examination) : Rs. 400/-(Per student, per practical examination)(iv) late fee:-(a) if the fee for an examination is not paid by due date, but paidwithin ten days after due date : Rs. 400/- (as late fee)(b) if the fee for an examination is not paid within ten days after due date fixed but paid after ten days and up to fifteen days before the commencement of the examination, the rates of fees including late fees shall be as under:-(i) fee for the 1st and 2ndyear : Rs. 1200/-(ii) fee for the 3rd and 4th year : Rs. 1400/8(v) fee for supplementary examinations : Rs. 600/-(up to two subjects)(vi) fee for diploma : Rs. 1000/-(vii) fee for mark sheet or duplicate mark sheet : Rs. 100/-(viii) fee for scrutiny or re-totaling of answer script : Rs. 500/-(ix) charges for examination and registration forms : Rs. 20/-(x) fee for change of examination centre : Rs. 1000/-(xi) migration fee : Rs. 1000/-(xii) charges or examination gazette : Rs. 5000/-(xiii) for college concerned : Rs. 500/-(xiv) fee for urgent mark sheet (within three days) : Rs. 500/-12-A. Tuition Fees etc:- The tuition fees in recognized Tibias / Homoeopathic / Ayurvedic Colleges shall be as follows, namely:-(i) Fee for 1st and 2nd year students : Rs. 1200/- p.m.(ii) Fee for 3rd and 4th year students : Rs. 1500/- p.m.12-B. Rates of Daily allowance and hotel charges.- The examination staff shall be entitled to daily allowance and hotel charges at the following rates, namely:-a) Superintendent of Examination Centres:(i) daily allowance at fixed rate of : Rs. 600/- per day(ii) hotel charges (without food and other charges) actual charges subject to a maximum of Rs. 1200/- per day for big cities and Rs. 800/- other cities.(iii) in case of non-provision of hotel bill a superintendent may claim hotel charges of a rate of two daily allowances per night as accommodation charges.b) Deputy Superintendent of Examination Centres:(i) daily allowance at fixed rate of : Rs. 400/- per day(ii) hotel charges (without food and other charges) actual charges subject to a maximum of Rs. 900/- per day for big cities and Rs. 600/- other station / cities.c) Invigilator of examination centres:(i) daily allowance at fixed rate of : Rs. 350/- per day(ii) hotel charges (without food and other charges) actual charges subject to a maximum of Rs. 600/- per day for big cities and Rs. 400/- other cities per day in case the invigilator is appointed from other cities; and9d) Other staff including water carriers, sweepers and Naib Qasidsdaily allowance at fixed rate of : Rs. 300/- per day12-C. Resident Superintendent.- (i) Resident Superintendent shall be paid a lump sum amount of five thousand as honoraria for the whole duration of examination held in his centre.(ii) Existing rates of fees and remunerations may be increased at rate of ten per cent after every two years.13 Funds of the Council.-(i) Grants by the Federal Government;(ii) Examination and other fees;(iii) Proceeds from sale of list and forms;(iv) Registration fees, renewal fees and practitioner’s card fee;(v) Donations;(vi) Registration card; and(vii) Sale of Publication (books & journals)(viii) Proceeds from any other project initiated by the Council after approval by the Federal Government.14. Expenditure by the Council.- (1) All moneys in the fund shall be used for the following purposes, namely:-(i) pay and allowances of officers and servants of the Council;(ii) travelling allowances and daily allowances of the President, Vice President and members of the Council;(iii) hiring, purchasing and construction of office and residential buildings;(iv) expenditure on holding meetings, examination and tests;(v) contingent expenditures;(vi) expenditure connected with research, including laboratories, libraries and museums; and(vii) such other expenditure as the Council may, with the approval of theFederal Government determines.(2) In incurring expenditure, the Council shall abide by all financial rules and instructions of the Federal Government in so far as they are not inconsistent with the Act or these rules.1015. Term of office of members.- The term of office of the members of the Council shall be five years, and the term of office of a member elected or nominated to a casual vacancy caused by the resignation, death or otherwise of a member shall be the remaining period of the term of the member in whose vacancy he was elected or nominated.16. Mode of election:- Elections to the Council shall be held:-(a) in the case of clause (b) of section 4 and clause (b) of section 5, by direct ballot on provincial basis.(b) in the case of clause (c) of section 4 and clause (c) of section 5, by ballot and on all Pakistan basis; and(c) in the case of clause (d) of section 4, by ballot and on all Pakistan basis.17. Electoral colleges:- For the purpose of elections to the Council the electoral colleges shall be:-(a) in the case of clause (b) of section 4, all registered practitioners, subject to the valid registration or renewals of the Unani system of medicine of each province.(b) in the case of election under clause (c) of section 4, teachers of all recognized institutions of the Unani or Ayurvedic system of medicine of all the Provinces provided their names appear on the register of teachers maintained by the Council.(c) in the case of clause (d) all recognized practitioners, subject to the valid registrations or renewal of the Ayurvedic System of Medicine of all the provinces.(d) in the case election under clause (b) of section 5, all the registered and listed practitioners, subject to the valid renewal, of the homoeopathic practitioners system of medicine of each provinces.(e) in the case of clause (c) of section 5, teachers of all recognized institutions of the Homoeopathic System of medicine of all the Provinces provided their names appear on the register maintained by the National Council for Homoeopathy, maximum 15 teachers shall be entitled per sixty seats of the college.1118. Federal Government to notify dates of election:- Whenever an election to the Council is to be held
